In practice the role is often filled by a gestor or an asesor fiscal.

Is it mandatory?

For residents of the European Union and the European Economic Area, appointing a representante fiscal is generally not compulsory. For residents from outside the EU and EEA, or in specific situations, Spain can require one. So whether you must have a representative depends mainly on where you are tax resident.

Why owners appoint one anyway

Even when it is not required, many non-resident owners choose to appoint a representative. The reasons are practical. The returns are in Spanish and follow Spanish rules, the calculations rely on the valor catastral and the correct percentages, and a small mistake can turn into a back payment with interest years later. A representative takes the annual return off your hands, keeps track of the deadlines and is reachable for the tax office if questions arise.

What a representante fiscal does

Typical tasks include preparing and filing your Modelo 210 each year, calculating the renta imputada or the taxable net rent, handling any payments and acting as the contact point for the Agencia Tributaria. A good representative will also flag changes that affect you, such as a move that changes your tax status from non-resident to resident, where very different rules apply.

Choosing a representative

When you appoint someone, make sure they are properly authorised to act before the Spanish tax authorities and that you agree clearly on which returns they handle and what it costs. Many owners work with the same gestor year after year, which keeps the paperwork consistent. It is not compulsory for EU and EEA residents, but for anyone who does not speak Spanish or would rather not do the research themselves, it is often money well spent.
