A poder notarial is a notarised power of attorney that authorises a third party to act on your behalf in legal, administrative, or financial matters in Spain. It is commonly used when you need someone to represent you at a government office, sign documents on your behalf, or handle a property transaction while you are abroad.

When you need one

The most common situations are: buying or selling property from abroad (the representative signs the escritura at the notary on your behalf), applying for an NIE when you cannot attend in person, handling tax filings through a gestor or asesor fiscal, and managing inheritance proceedings. Some gestores require a poder notarial before they can act on your behalf with the Agencia Tributaria, though the AEAT also offers a digital apoderamiento register that avoids the notary step entirely.

Types of poder notarial

A poder general grants broad authority across many types of actions. A poder especial is limited to a specific action or transaction, such as signing one particular property deed. For most administrative purposes, a poder especial is sufficient and safer, because it limits what the representative can do. Notaries will advise on which type fits your situation.

Costs

Notary fees for a poder notarial in Spain typically range from 50 to 150 euro, depending on the complexity and the notary. If you create the poder abroad, it must be apostilled and, if not in Spanish, officially translated by a sworn translator (traductor jurado). This can add several hundred euro to the total cost.

The digital alternative: apoderamiento at the AEAT

For tax related matters, the AEAT offers a digital apoderamiento register through its sede electrónica. You can authorise a gestor or tax adviser to file returns and access your tax information without visiting a notary. This is done entirely online with your Certificado Digital and is free. It covers most routine tax interactions but does not replace a notarial poder for property transactions or legal proceedings.
